VITech's Acceptable
Use Policies
VITech makes its WWW servers available
to subscribers of its Web presence services (henceforth This Service),
but does not necessarily endorse any of the items published through
its servers.
We reserve the right to refuse to serve the web presence materials
of any existing user making inappropriate or unreasonable use of This
Service or an applicant whose planned web presence activities are
deemed to have the potential of creating negative impact on VITech's
abilities to serve its customers. The appropriateness and reasonableness
of use and the potential of creating negative impact are to be determined
by the staff maintaining VITech's
servers. The term "web presence materials" is defined as
data of any form that can be delivered by VITech's
web presence software and hardware resources, including but not limited
to its web server software, workstations, and Internet link.
Examples of inappropriate or unreasonable use:
- providing copyrighted materials without authorization
- providing obscene or offensive materials (e.g. porno materials)
- providing materials whose nature and/or volume compromises the
ability of VITech's
servers to serve other users' web presence materials, instances
including but not limited to unreasonable consumption of disk
space, Internet link bandwidth, CPU, and memory usage, as determined
by VITech web server maintenance
staff
- providing materials that violate the commonly accepted etiquette
of the Internet
- providing materials that are deemed by the government authorities
as inappropriate or illegal. Any such government determinations
will be binding on the user, not VITech
Users notified of inappropriate or unreasonable usage who fail to
correct the situation can lose their web service. This service is
not actively monitored for content, however, so please send reports
of inappropriate use to hostmaster@vit.net.
When you sign up any one of our services, we regard the filled
out form as a binding contract and will treat and honor it as
such. We always double check the content of the submitted form(s)
and will discuss any questionable entries with you. However, we are
not responsible for any mistakes, oversight, or missing information.
If we have taken actions based on the information provided in the
form and later on you request us to repeat the process based on some
new information from you, we will charge you the same amount of service
fee.
Domain Name Update
Policies
After your domain name registration has been completed, you become
the owner (administrative contact) of the domain. Thus, you are entitled
to submit modification request(s) to NIC for updating your domain
record in the NIC whois database. The form together with instructions
are available directly from InterNIC's
web site. As there is no Domain Name Services (DNS) involved in
minor updates, you can do this easily by following the instructions
and then mail the completed form to InterNIC.
The one time service fee that you have paid to VITech
for registering your domain name does not cover such update
request(s).
VITech will prepare and submit
such update request(s) for you if you so desire. However, we will
charge you a fee for such services.
Account Usage and Performance
Policies
Once you have opened a web presence account at VITech,
as long as the above service policies are observed, you have full
freedom as far as how to structure/update your web docs is concerned.
You can name them any way you wish, revise them anytime you prefer,
or place some of them in different sub-directories for example.
One implication of the above is if you engage in commercial web presence
consulting activities and would like to place your clients' web docs
in your account, it is completely acceptable to us, as long as you
do so in the following manner:
- If you are a Basic Service customer (assuming your account ID
is joe), and you have three clients whose opening home page is
company1.html, company2.html, and company3.html, then you can
advertise their URLs as:
- http://www.vit.net/joe/company1.html
- http://www.vit.net/joe/company2.html
- http://www.vit.net/joe/company3.html
- If you are a Virtual Host customer (assuming your domain name
is business.com), and you have three clients whose opening home
page is company1.html, company2.html, and company3.html, then
you can advertise their URLs as:
- http://www.business.com/company1.html
- http://www.business.com/company2.html
- http://www.business.com/company3.html
- Of course, if your own opening home page is index.html, then
your own URL is still http://www.business.com
However, if you would like to setup Virtual Host accounts for your
clients, we will NOT set up their accounts such that their disk
spaces and yours are shared.
In other words, each VITech Virtual
Host account is an independent identity, in the sense that it has
its own domain name, virtual web server, virtual FTP server, email
forwarding, FTP login ID/password, and disk space. Data transfer
is also metered independently for each Virtual Host account even you
may have more than one account with VITech
and surcharges, if any, will be independently computed for and applied
to each Virtual Host account.
VITech shall try its best to maintain
a reserve of Virtual Host accounts to meet its users' demand. However,
owing to many technical reasons and various other unforeseeable factors,
such a goal may not be always reachable. VITech
shall not be held obligatory to provide such accounts at any time
and disclaims any liabilities in case it can not provide such accounts
to any parties.
Users of VITech's
web presence resources understand that VITech
does not own or control any networks other than its own internal network,
nor is responsible for performance (or non-performance) within such
networks. However, VITech will
work with its Internet connectivity provider and area TELCO to maximize
its Internet link's performance for its customers.
Surcharge Collection
Policies
If, despite the generous default disk space and data transfer monthly
limits, an VITech account's disk
consumption and/or monthly data transfer exceed their respective default,
surcharges listed in the VITech
on line pricing models apply.
Other than under the circumstance noted below, any surcharges are
to be collected at the end of the calendar month in which the surcharges
are incurred, regardless the starting date and the length of subscription
of the said account.
The owner(s) of the said account will be notified via email about
the surcharges, and a payment should be sent to VITech
within two weeks (the grace period) from the end of the calendar month.
If VITech doesn't receive the
payment within the grace period, the said account's expiration date
will be adjusted to an earlier date in a prorated manner (per the
account's current payment plan). If the later action is taken, a notice
will be sent to the account's owner(s) via email.
Late payments will not be accepted.
If the said account's resource usage continues to show a trend that
may cause a payment default, the account owner(s) will be notified
within the calendar month. If no appropriate remedies are taken
by the said account's owner(s), the account may be terminated early.
Data residing in the account will be purged permanently. VITech
explicitly disclaims any liabilities resulting from such data purging.
A notice will be sent to the said account's owner(s) when such an
action is taken by VITech.
At any rate, the said account's owner(s) are liable for any amount
that is owed to VITech.
Refund and Termination
Policies
We at VITech pride ourselves in
providing high quality web presence services at the most competitive
prices. However, should you decide to terminate your subscription
anytime after you have signed up, we will gladly refund you per the
following policies:
- Domain Name Registration fees are not refundable (see NOTE
1)
- Set Up fees are not refundable
- Monthly service fees are prorated and then the balance is refunded
subject to the conditions given in NOTE 2 and NOTE 3:
NOTE 1.: we will not charge you a fee if we can not complete
your Domain Name Registration.
However, if you have enlisted other Internet service companies to
apply for the same domain name, even our application is rejected
by NIC, because of the reason that other companies have submitted
applications for you earlier than we have, we will not refund you.
As in this case, failing to have our applications accepted by NIC
is NOT our fault, and we have done all paper work, hardware
and software configurations for you.
NOTE 2.: (for Virtual Host accounts) should you decide to terminate
a long term subscription (i.e. a subscription that lasts longer than
or equal to a quarter) before the expiration date, the refund will
be calculated in the following manner:
- less than a quarter - no discounts in calculating and prorating
your refund.
- less than half a year, but longer than or equal to a quarter
- 5% discount is to be used in calculating and prorating your
refund.
- less than a year but longer than or equal to half a year - 10%
discount will be used in calculating and prorating your refund.
If you specify the cancellation date in your cancellation notice to
us, it will be used in the above calculations. Otherwise, the date
that we receive your cancellation notice is used by default.
NOTE 3.: (for Basic Service accounts) since there are no discounts
for such an account, so the refund will be simply prorated.
Data residing in any terminated accounts are to be purged permanently
on a schedule determined by VITech.
VITech explicitly disclaims
any liabilities resulting from such data purging.
Site Security Policies
To keep our site security level high, we do not allow user CGIs
on our server. We provide general purpose and flexible CGIs to
our customers. If you do have special needs and prefer to write your
own, please contact other service providers who are willing to accommodate
your wishes, or for more control (and responsibilities/expenses!),
set up your own server(s).
Or, rather than bothering with inefficient and awkward CGI scripts,
learn the far more flexible and versatile Java
language from Sun Microsystems, Inc..
It allows you to develop so called applets for various multimedia
web presence activities such as animation, audio/video delivery, and
databases. Applets are secure, run on client computers (thus much
faster after it's downloaded) and are the future of the web. You may
wish to learn and use the easier Netscape's Javascript
first however.

For the same reason and to keep our server delivery performance high,
all server side include (SSI) features have been disabled completely
for now. We may selectively offer some SSI features at our discretion
in the near future.
Furthermore, telnet access will not be granted under any circumstances.

Indemnity
VITech user agrees to indemnify and hold VITech
harmless against any claim, actions or demands arising out of content
disseminated from the user's web presence materials, delivered via
VITech's
web presence resources.
Liability
Neither VITech nor its customers
shall be liable to the other for any loss, damage, liability, claim
or expense arising out of or in relation to the policies presented
herein, other than for payment of fees and refunds and for indemnification
discussed in this statement, however caused. IN NO EVENT SHALL VITech
BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE OR OTHER CONSEQUENTIAL
DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS) ARISING OUT
OF OR IN RELATION TO THE POLICY STATEMENT. VITech's ENTIRE LIABILITY
AND THE CUSTOMER'S EXCLUSIVE REMEDY SHALL BE AT VITech's
OPTION, PER POLICIES LISTED SO FAR.
